OFFICIAL CONTEST RULES AND REGULATIONS

By participating in the “Enter for a Chance to Win a Pair of Tickets to Mission Hill’s 2025 Summer Concert Series” Contest (the “Contest”), you are signifying your agreement that you have read and agree to be legally bound by these official contest rules and regulations (the “Rules”). The decisions of Mission Hill Family Estate, a division of Mark Anthony Group Inc. (the “Sponsor”) of 1730 Mission Hill Road, West Kelowna, BC V4T 2E4, with respect to all aspects of the Contest are final and binding.

1. CONTEST PERIOD. The Contest begins at 12:00:01 am Pacific Time (“PT”) on May 1, 2025 and ends at 11:59:59 pm PT on June 30, 2025 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest.

2. ELIGIBILITY. To enter the Contest and be eligible for a chance to win a prize a person (the “Entrant”) must be a legal resident of British Columbia who is at least 19 years old at the time of entry. Persons are not eligible to enter if they: a) are an employee, director, representative, agent or officer of the Sponsor, its parent companies, subsidiaries, affiliates, advertising or promotional agencies, prize suppliers, or any other individual or entity involved in the development, production, administration or fulfillment of the Contest (collectively the “Contest Parties”); b) are an employee of or contractor to any provincial liquor authority or any participating licensed establishment; or c) are a member of the immediate family (defined as parents, siblings, children, spouse and life partner, regardless of where they live) or household (whether related or not) of any of the above-referenced persons.

3. HOW TO ENTER: No Purchase Necessary. A purchase will not improve your chances of winning. To enter, go to https://www.missionhillwinery.com/summer-concert-series/concert-contest or scan the QR code available at participating locations during the Contest Period, which will direct you to an online official entry form (“Entry Form”), and fully complete the Entry Form with all the required information and follow the instructions provided to submit your Entry Form. Once you have provided all of the required information and completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”). To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period.

Entry Limit: There is a limit of one (1) Entry per person during the Contest Period. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, and/or e-mail addresses; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; and/or (iv) disrupt or participate in the Contest in any other fraudulent, abusive, deceptive, unfair or misleading way; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry is not otherwise in compliance with these Rules (all as determined by Sponsor in its sole and absolute discretion).

Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device or other electronic devices. Please contact your service provider for pricing and service plan information and rates before any mobile or electronic device participation.

4. PRIZE. Alcohol is not part of the prize. There will be one (1) Prize (the “Prize”). The Prize is provided by the Sponsor. The approximate retail value (“ARV”) of the Prize is up to one thousand two hundred Canadian dollars ($1,200 CAD), and will vary depending on the winner’s place of residence and the discretion of the Sponsor regarding the awarding of the Prize in accordance with Rule 4 i) and ii) below.

The Prize is for the winner and one (1) guest, and the Prize to be won will vary depending on the winner’s circumstances in accordance with the criteria set out below.

i) If the winner does not reside within two hundred (200) kilometres of Kelowna International Airport, British Columbia, the Prize includes: two (2) tickets for the Andy Grammer Concert at Mission Hill Family Estate on July 31, 2025; one (1) night double occupancy accommodation at the Delta Hotel in Kelowna, BC; and round-trip, coach class air transportation from the major airport nearest winner’s home to Kelowna, BC.
ii) If the winner resides within two hundred (200) kilometres of Kelowna International Airport, British Columbia, the Prize includes: two (2) tickets for the Andy Grammer Concert at Mission Hill Family Estate on July 31, 2025; and one (1) night double occupancy accommodation at the Delta Hotel in Kelowna, BC.

There is a limit of one (1) Prize per person. No more than the advertised number of prizes will be awarded. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the potential winner by e-mail or telephone. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. All arrangements relating to the Prize must be made through the Sponsor or its designated agents.

All travel must take place by July 31, 2025 (or on such other dates as specified by the Sponsor in its sole and absolute discretion). Travel dates are subject to availability; blackout periods, government restrictions and regulations, and other restrictions may apply. The potential winner and their guest(s) must travel on the same itinerary. Potential winner and guest(s) is/are responsible for having all necessary documentation to permit travel and participate in the Prize, including government identification and/or passports, and all required COVID-19 documentation (including, without limitation, any required proof of vaccine documentation, proof of valid vaccine exemption documentation, and/or proof of negative COVID-19 test documentation). The potential winner and guest(s) hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the Prize. It is strongly recommended and encouraged that the potential winner and their guest(s) obtain sufficient personal travel and medical insurance prior to any Prize-related travel. The potential winner (and, if applicable, their guest(s)) must comply with any applicable hotel check-in requirements, and may be required to make a deposit or payment in advance or present a valid major credit card in their name at the time of hotel check-in to cover any incidental expenses. The potential winner’s guest(s) must be at least 19 years of age, and once selected by the potential winner, their guest(s) cannot be changed without the express consent of Sponsor, which may be withheld for any reason.

Without limiting the foregoing, the following terms and conditions apply to the Prize, as applicable: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash, another prize or otherwise (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the potential winner, including without limitation, airline baggage fees, gratuities, meals, transportation, personal expenses of any kind or nature, federal, provincial and local taxes, room taxes and other hotel fees, charges and/or fees arising from changes, and any other incidental costs or expenses; (iv) if the potential winner (and as applicable, their guest(s)) does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole and absolute discretion, a cash award; (vi) neither Sponsor nor any of its prize providers will replace any lost, stolen or destroyed tickets, gift cards, promotional cards or vouchers; (vii) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, the point of departure and fluctuations in the cost of air transportation); (viii) Prize may not be exactly as shown in promotional materials; (ix) by accepting the Prize, the potential winner (and as applicable, their guest(s)) agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) if the Prize includes guest(s), guest(s) must be at least 19 years of age; and (xi) by participating in a Prize or any portion thereof, the potential winner (and as applicable, their guest(s)): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties (as defined below) have not made any warranties, guarantees or representations about their safety while participating in the Prize.

The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the potential winner (and as applicable, their guest(s)) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The potential winner (and as applicable, their guest(s)) will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and/or screening requirements.

None of the Released Parties (as defined below) makes any representation or offers any guarantee or warranty, express or implied, in fact or in law, as to the quality, authenticity, merchantability, mechanical condition or fitness of any prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the potential winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.

By entering this Contest and accepting the Prize, the potential winner agrees to maintain their (and as applicable, their guest(s)) behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest-related or Prize-related activity. The potential winner understands and agrees that Sponsor, or prize providers have the right, in their sole discretion, to disqualify and remove the potential winner (and as applicable, their guest(s)) from any activity at any time if the potential winner (and as applicable, their guest(s)) behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest-related party or otherwise violates the policies of the prize providers, and in such a case, the potential winner will still be solely responsible for all expenses related to the Prize.

5. WINNER SELECTION: A random draw will be conducted from all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select one (1) eligible entrant on or around July 2, 2025 (the “Selection Date”) at 1730 Mission Hill Road, West Kelowna, BC V4T 2E4 by the Sponsor or its designated representative(s), and such selected entrant(s) will be deemed the potential winner(s).

The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.

6. WINNER NOTIFICATION PROCESS. The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the potential winner (using the information provided at the time of entry) within three (3) business days of the Selection Date. If the potential winner cannot be contacted within three (3) business days of the Selection Date, or if there is a return of any notification as undeliverable; then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential winner. No communication will be entered into by the Sponsor with entrants except with selected entrants. The Sponsor is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response.

7. WINNER CONFIRMATION PROCESS. BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective successors and assigns, any provincial liquor authorities and any participating licensed establishments (collectively, the “Released Parties”) from any and all liability, directly or indirectly, in connection with this Contest, including without limitation use of the potential winner’s Contest-related information (or any portion thereof), their participation therein, the awarding, receipt, possession or use/misuse of the Prize or any portion thereof, and/or their violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, or infringe on any rights and/or interests of any third party; and (iv) agrees to the publication, reproduction and/or other use of the potential winner’s name or other likeness without further notice or compensation, in perpetuity throughout the world, in any publicity or advertisement carried out by or on behalf of the Sponsor. This release shall continue in force following the termination of the Contest and/or awarding of any prize. Where applicable, potential winner’s guest(s) may also, at the discretion of the Sponsor, be required to properly execute Contest documents within the specified time as a condition of participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof.

If a potential winner: (a) fails to return the properly executed Contest documents within the specified time; (b) fails to correctly answer the skill-testing question; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (d) at any stage supplied untruthful, incomplete, inaccurate or misleading information (as determined by the Sponsor in its sole and absolute discretion); and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the potential winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential winner in accordance with the winner selection procedure described above (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).

GENERAL RULES

8. The provincial liquor agencies are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.

9. The Contest is governed by the laws of Canada and the Province of British Columbia and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of British Columbia for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.

10. All Entries become the property of the Sponsor. This Contest is void where prohibited and is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

11. By entering this Contest, each Entrant agrees to abide by and be bound by these Rules and to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the potential winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of the Prize, and each selected potential winner agrees to sign the Sponsor’s declaration and release documents (see Rule 7 above) in this regard before receiving their Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.

12. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the accuracy and/or legitimacy of any Entry, or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

13. Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through the use of any automated, macro, script, robotic or other system(s) or program(s). All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.

14. In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).

15. Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure, and if applicable, subject to approval from any provincial liquor authority. The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

16. No responsibility is assumed by the Sponsor and the other Released Parties for any inability of a potential entrant to successfully enter the contest for any reason. The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above. Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and their participation therein.

17. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

18. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://www.missionhillwinery.com/privacy-policy/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

19. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.

20. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
